Terms of Use

These terms are an agreement between you and DAG LLC (“we”, “our”, or “us”) covering the Smart EV Guides mobile application and the online services it uses (together, “the App”). By installing or using the App you accept these terms. If you do not accept them, do not use the App.
The App is reference material, not a decision-maker. It exists to put manufacturer emergency response information in front of you quickly. It does not replace your training, your department's standard operating procedures, incident command, or your own judgment on scene.
Vehicles get modified, damaged, and updated in ways no reference can anticipate, manufacturer documentation is revised, and our content may be incomplete or wrong for the vehicle actually in front of you. Treat every vehicle as energized and hazardous regardless of what the App shows. Where the App and the manufacturer's current documentation disagree, the manufacturer governs.
Your licence to use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for emergency response, training, and preparedness. You may show and discuss its content in the course of that work.
You may not:
- Redistribute, resell, sublicense, or publish the App's compiled guide content as a product or dataset of your own.
- Reverse-engineer, decompile, or extract the App's models or content in bulk, except where that restriction is unenforceable by law.
- Share a paid subscription or a department code outside the department it was issued to, or use automated means to make requests at a volume a person could not.
- Use the App unlawfully, or to build a competing service.
Free and Pro
The offline rescue guides bundled with and downloaded by the App are free and unlimited, permanently. That is deliberate: the material most likely to be needed on a scene with no signal is never behind a paywall. A Pro subscription adds capability on top of it.
Departments can instead licence access for their members under a department plan; contact us for terms. The free daily allowance, and which capabilities sit on which side of the line, may change as the product develops — but the offline guides staying free will not.
Subscriptions, billing, and cancellation
Pro is an auto-renewing annual subscription sold through the app store you installed from — Apple's App Store or Google Play. The price shown in the App at the time of purchase governs; it is charged in your local currency and may differ by region.
- Renewal. Your subscription renews automatically for another year unless you cancel at least 24 hours before the current period ends. The store charges your account within 24 hours of the period ending.
- Cancelling. Cancel any time in your App Store account settings or your Google Play subscription settings — not in the App, which cannot cancel on your behalf. Cancelling stops the next renewal; you keep Pro access until the period you already paid for ends.
- Refunds. The store, not us, processes payments and refunds. Requests go to Apple or Google under their published refund policies. We can help you work out what happened, but we cannot issue a refund for a store purchase ourselves.
- Price changes. If we change the price, the store will notify you and, where its rules require, ask you to consent before the change applies to a renewal.
- One account, one subscription. Pro follows the store account that bought it, and restores to that account on your other devices. It is not transferable between store accounts.
If a payment fails, the store may retry or place the subscription on hold; Pro access pauses while it is unresolved and resumes if the store recovers the payment. Losing Pro never removes your offline guides.
Where the content comes from
Guide content is derived from manufacturer emergency response guides and rescue sheets and from public sources such as NHTSA. Those documents remain the property of their publishers; our compilation, wording, and software are ours. Vehicle names and marks belong to their manufacturers, who do not sponsor or endorse the App.
Two features generate or fetch information rather than reading it from a bundled guide, and both carry additional uncertainty:
- Online AI search composes an answer from source documents. It can be incomplete, out of date, or wrong. Check the source pages it cites.
- Plate and VIN lookup returns a vehicle identification from a third-party data provider. It can return the wrong vehicle or none at all. Confirm against the vehicle itself.

No warranty
The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, available when you need it, error-free, or that its content is accurate, complete, or current for any particular vehicle.
Online features depend on connectivity and third-party services and can be unavailable. Design your procedures so that a scene never depends on the App being reachable.
Limitation of liability
To the fullest extent permitted by law, DAG LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of life, personal injury, property damage, lost profits, or lost data, arising out of or relating to your use of or inability to use the App — including any reliance on its content — whether based in contract, tort, or any other theory, and even if we were advised such damages were possible.
Our total aggregate liability arising out of or relating to the App will not exceed the greater of (a) the amount you paid us or through an app store for the App in the twelve months before the claim arose, or (b) fifty US dollars.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for personal injury or for incidental or consequential damages. Where that is so, the above exclusions and limits apply only to the extent permitted, and nothing here limits liability that cannot lawfully be limited.
Suspension and termination
You may stop using the App at any time by uninstalling it. We may suspend or terminate access, including a department plan or code, for breach of these terms or for use that threatens the service. If we terminate a paid subscription without cause, the remaining paid period is refundable through the relevant store. Provisions on content ownership, warranty, liability, and governing law survive termination.
Privacy
Our handling of information is described in the Privacy Policy, which forms part of these terms. In short: there is no account, no advertising or tracking, no location collection, and plate and VIN lookups are never logged.
Changes to these terms
We may update these terms. The current version is always at this URL with the “Last updated” date above. Material changes affecting a paid subscription take effect at your next renewal. Continued use after a change constitutes acceptance.
Governing law
These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Colorado have exclusive jurisdiction over any dispute, and you and we consent to venue there — except that either party may seek injunctive relief in any court of competent jurisdiction. Nothing here deprives a consumer of the protection of mandatory law in their place of residence.
